PrimeTracers Data API — Terms of Service

Effective Date: January 1, 2026 — Version 1.0

IMPORTANT — PLEASE READ CAREFULLY. By accessing or using the PrimeTracers Data API, you agree to be legally bound by these Terms of Service. If you do not agree, you must not access or use the API.

1. Overview and Acceptance

Prime Tracers LLC ("PrimeTracers," "we," "us," or "our") operates a data enrichment platform accessible at data.primetracers.com (the "API" or "Service"). The API provides programmatic access to consumer contact data, property and real estate data (including Valuation Models and Predictive Models), business and firmographic data, and demographic and lifestyle data (collectively, "Data").

These Terms of Service ("Terms") govern your access to and use of the API, including all associated documentation, endpoints, keys, and data outputs. By registering for an API key, accessing any endpoint, or integrating the API into any application, system, or workflow, you ("Client," "you," or "your") agree to be bound by these Terms, our Privacy Policy, and any applicable order form or addendum executed between you and PrimeTracers.

2. API Keys, Access, and Security

2.1 Issuance of API Keys

Upon approval of your application, PrimeTracers will issue you one or more unique API keys ("Keys"). Keys are personal to your account and must not be shared, published, embedded in public repositories, or transferred to any third party.

2.2 Queue-Based Delivery Model

The PrimeTracers API operates on a first-come, first-served queue system. By using the API, you acknowledge and accept the following:

Response times may vary depending on current queue depth and system load.
There is no guaranteed response time or real-time SLA for individual API calls.
PrimeTracers will make commercially reasonable efforts to maintain availability, but outages, maintenance windows, and queue backlogs may occur.
PrimeTracers shall not be liable for delays, failed requests, or data unavailability resulting from queue conditions or infrastructure limitations.

2.3 Key Responsibility

You are solely responsible for all API calls made using your Key(s), regardless of whether those calls were made by you, your authorized users, your customers, or any unauthorized third party who obtained access to your Key.

2.4 Security

You must implement commercially reasonable security measures to protect your Key(s) from unauthorized access. If you believe a Key has been compromised, you must notify PrimeTracers immediately at [email protected] and request a replacement Key.

3. Permitted Uses

You may use the API and Data only for lawful business purposes, including but not limited to:

Sales prospecting, lead generation, and marketing outreach.
Data enrichment of your own first-party CRM or marketing databases.
Real estate research, property valuation, and investment analysis.
Skip tracing and people search for lawful purposes, including debt collection, process serving, and asset location.
Mortgage pre-screening, property underwriting support, and lender research workflows, subject to FCRA restrictions in Section 5.
Proptech application development, including embedding Data in your licensed software products for use by your end customers.
Market research, audience segmentation, and demographic analytics.
B2B and B2C marketing communications, subject to CAN-SPAM, TCPA, and applicable state laws.

Data resale is NOT a permitted use under these Terms. If you wish to resell or redistribute Data, you must execute a separate PrimeTracers Data Reseller Agreement. Unauthorized resale is a material breach of these Terms.

4. Prohibited Uses

The following uses are strictly prohibited and constitute a material breach of these Terms:

Any use of the Data as a factor in decisions governed by the Fair Credit Reporting Act (FCRA).
Using AVM outputs as the sole or primary basis for a credit decision or as a substitute for a licensed appraisal.
Reselling, sublicensing, or redistributing Data outputs to third parties as a standalone data product without a separately executed PrimeTracers Data Reseller Agreement.
Using the Data to harass, stalk, threaten, or unlawfully discriminate against any individual.
Scraping, caching, or building derivative databases from API outputs for purposes of competing with PrimeTracers.
Disclosing PrimeTracers as your data source to any end customer, consumer, or third party, except as required by applicable law.
Any use that violates TCPA, CAN-SPAM, state do-not-call rules, or applicable email marketing laws.
Any illegal, fraudulent, deceptive, or unauthorized purpose.

5. Data Compliance Obligations

5.1 Your Compliance Responsibility

You are solely responsible for ensuring that your use of the API and Data complies with all applicable federal, state, and local laws, including the FCRA, TCPA, CAN-SPAM Act, CCPA/CPRA, and applicable state consumer data protection laws.

5.2 Do-Not-Call and Suppression Compliance

Phone number data delivered through the API has not been processed against the National Do Not Call Registry or state suppression files prior to delivery. You are solely responsible for scrubbing all phone numbers against applicable suppression lists before initiating any telephone marketing or outreach.

5.3 FCRA Notice

THE DATA PROVIDED THROUGH THIS API IS NOT INTENDED FOR USE AS A CONSUMER REPORT UNDER THE FCRA. PRIMETRACERS IS NOT A CONSUMER REPORTING AGENCY. YOU MUST NOT USE THE DATA AS THE BASIS FOR ANY ADVERSE ACTION AGAINST A CONSUMER IN CONNECTION WITH ANY FCRA-COVERED DECISION.

5.4 Consumer Requests and Opt-Outs

If a consumer contacts you asserting rights under applicable privacy law in connection with Data obtained through PrimeTracers, you are solely responsible for responding. You must not refer consumers to PrimeTracers or disclose PrimeTracers as your data source under any circumstances.

6. Service Availability

The PrimeTracers API is delivered on a best-effort, queue-based architecture. PrimeTracers may implement rate limits, throttle requests, or temporarily suspend endpoint access for maintenance or abuse mitigation without prior notice. PrimeTracers shall have no liability for losses or damages arising from API downtime, delayed responses, or queue backlogs.

7. Data Accuracy and Disclaimer

THE DATA IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS WITH ALL FAULTS. PRIMETRACERS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND COMPLETENESS. You assume all risk arising from your reliance on or use of any Data output.

8. Fees, Billing, and Overage

Subscription fees are due and payable in advance of each billing period.
Overage usage beyond your included credit allowance will be billed at the per-record overage rate applicable to your plan tier.
Disputed invoices must be raised in writing within fifteen (15) days of invoice date.
PrimeTracers reserves the right to suspend API access upon non-payment after three (3) days written notice.
You are responsible for all API call volume generated through your Key(s).

9. Intellectual Property

PrimeTracers retains all right, title, and interest in and to the API, platform, Data, and all underlying compilations, databases, models, and intellectual property. These Terms do not transfer any ownership or proprietary rights to you.

10. Confidentiality

You agree to maintain the confidentiality of your API Key(s) and any proprietary technical documentation provided by PrimeTracers, using such information solely to exercise your rights under these Terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless Prime Tracers LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the API or Data in violation of these Terms or applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIMETRACERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. PRIMETRACERS' TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU DURING THE SIX (6) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13. Term and Termination

These Terms remain in effect for as long as you hold an active API key or subscription. PrimeTracers may suspend or terminate your API access immediately, without prior notice, if you are in material breach of these Terms, fail to timely pay fees, or your use poses legal or regulatory risk. Upon termination, your Key(s) will be deactivated, you must cease all use of the API and Data, and all outstanding fees become immediately due.

14. Modifications

PrimeTracers reserves the right to update or modify these Terms at any time. Material changes will be communicated via email or by posting a notice at data.primetracers.com. Continued use of the API following any modification constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware. Any dispute shall be submitted to binding arbitration in Delaware under the rules of the American Arbitration Association. Each party waives any right to a jury trial.

16. General Provisions

These Terms constitute the entire agreement between you and PrimeTracers with respect to the API. If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign your rights under these Terms without PrimeTracers' prior written consent.
